1. Acceptance of Terms

By accessing or using any Genie9 service, including BigMIND, G Cloud, and other products ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our Services.

2. Description of Services

Genie9 provides cloud-based backup, storage, and data protection services. Our Services include automated backup, file synchronization, disaster recovery, and related features as described in our product documentation.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Acceptable Use

You agree not to use our Services to: • Store or distribute illegal content • Violate any laws or regulations • Infringe on intellectual property rights • Distribute malware or harmful code • Attempt unauthorized access to our systems • Interfere with the proper functioning of our Services

5. Payment Terms

Paid subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees and charges. Prices are subject to change with notice. Refunds are provided according to our refund policy.

6. Your Data

You retain all rights to your data. You grant us a limited license to store, process, and transmit your data solely to provide the Services. We will not access your data except as necessary to provide support or comply with legal obligations.

7. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Services will end. You may download your data for 30 days after termination. After this period, we may delete your data.

8. Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENIE9 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.

Additional Terms

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Genie9 Limited is incorporated, without regard to its conflict of law provisions.

International Use

Our Services are available worldwide. By using our Services from outside our home jurisdiction, you agree to comply with all local laws regarding online conduct and acceptable content.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Genie9.

Enterprise Customers

Enterprise customers may be subject to additional terms as specified in their Enterprise Agreement. In case of conflict, the Enterprise Agreement prevails.
